Welcome to Peach Gelato. By using our apps ("Zesty," "Just Meditate") and services (collectively, the "Service"), you're agreeing to these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By accessing or using our Service, you confirm that you can form a binding contract with Peach Gelato, that you accept these Terms, and that you agree to comply with them. If you don't agree to these Terms, you must not use our Service.

2. Description of Service

Peach Gelato provides apps designed to "bring joy" to daily life. "Zesty" helps users track their ADHD medication. "Just Meditate" provides simple, accessible meditation.

Important Medical Disclaimer (for Zesty): Zesty is a tracking tool. It is not a medical device, nor does it provide medical advice. The information in the app is for informational purposes only. Always consult your doctor or a qualified healthcare provider with any questions you may have regarding a medical condition or medication. Never disregard professional medical advice or delay in seeking it because of something you have read or tracked in this app.

3. Subscriptions & Payments (for Zesty)

Our app "Zesty" requires a paid subscription to access features. Subscriptions are managed exclusively through the Apple App Store.

• Billing: Your subscription will be charged to your Apple ID account at confirmation of purchase.
• Auto-Renewal: Your subscription automatically renews unless you cancel it at least 24 hours before the end of the current billing period.
• Cancellation: You can manage and cancel your subscriptions by going to your App Store account settings after purchase.
• Refunds: All payments are non-refundable and non-transferable. Any refund requests must be made directly to Apple.

4. User Conduct

You agree not to misuse the Service. For example, you must not (and must not try to):

• Use the Service for any illegal or unauthorized purpose.
• Reverse-engineer or decompile the app.
• Interfere with the security or integrity of our systems.

5. Intellectual Property

All content, design, code, and "look and feel" of the Service are the exclusive property of Peach Gelato. You may not duplicate, copy, or reuse any portion of the visual design or code without our express written permission.

6. Limitation of Liability

To the fullest extent permitted by law, Peach Gelato shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use of or inability to use the Service; (b) any unauthorized access to or use of our servers.

7. Termination

We reserve the right to suspend or terminate your access to the Service at any time, without notice or liability, for any reason, including if you breach these Terms.

8. Governing Law

These Terms shall be governed by the laws of the State of California, without regard to its conflict of law provisions.

We may modify these Terms from time to time. We will always post the most current version on our website. By continuing to use the Service after changes become effective, you agree to the new terms.
